Patna: Bihar Human Rights Commission (BHRC) on Monday directed the Home department, Bihar government, to pay within two months a compensation of Rs 75,000 to Harendra Sah, son of Gourishanker Sah,  of village Rajadih under Tariyani police station in Sheohar district for the Human Rights violation he suffered due to wrong medical report issued by a doctor benefiting the accused who had assaulted him on February 23, 2015

The BHRC has also directed the Sheohar SP to examine the criminal culpability  of primary health centre (PHC) incharge in issuing  wrong injury report benefiting the accused  and take legal action accordingly. It also directed the state Health Department  to  inform the Commission about  administrative  action taken against Medical Officer (MO), incharge,  PHC, Tariyani, by August 31, 2016, said BHRC Member Neelmani.

Harendra Sah, the petitioner, had complained  to the Commission that when  he asked for his dues from  Ramashanker Sah on February 23, 2015, he  was assaulted  and dragged by  Ramshanker Sah and three others with the result his spinal cord and  ribs were fractured incapacitating him but due to connivance  of the  SHO and  the Doctor incharge Primary Health Centre (PHC),  Tariyani, the  case was a registered under lighter sections of IPC benefiting  the accused. The doctor did not prescribe X- ray nor did he refer him to higher centre for treatment.

The Commission had asked for response of SP, Sheohar, who informed that the case was registered at  Tariyani PS in this connection. Dr Sudhir Sharma, MO, incharge, PHC, Tariyani gave injury report on February 24, 2015, stating  “He complains of body ache.  Found no external  injury”. The Medical Board constituted at the behest of SP, Sheohar, found the injury of the petitioner as grievous (corroborating  the fracture  etc) and accordingly  section 325 IPC has been added in the chargesheet  subsequently submitted to the Court.  The accused had been enlarged on bail by the Court earlier. Allegations of the petitioner that wrong injury report was issued by the PHC doctor has been established and SP, Sheohar, has requested Civil Surgeon, Sheohar, for action  for against the said doctor. The case will be listed again on September 6, 2016.
