Patna: The Supreme Court (SC) on November 24 cancelled the bail granted to suspended  RJD MLA from Nawada Raj Ballabh Yadav by Patna High Court (HC) and told Bihar goevrnment “let him remain in jail”.

Justice A K Sikri and Justice Abhay Manohar Sapre while hearing the petition filed by government of Bihar challenging Patna High Court order granting bail to Raj Ballabh, who is charged with raping a minor girl of Biharsharif, asked from the state lawyer “Whether Raj Ballabh Yadav was already released on bail”. When the state lawyer informed the judges that he was not released, the division bench said “Let he him remain in jail”.
Raj Ballabh was granted bail by  Biharsharif court under Protection of Children from sexual offences Act on November 23, 2016, and he was expected to be set free on November 24. The SC had reserved its order on November 23 and announced the verdict in the morning on Thursday.

Bihar government had challenged the High Court order. Raj Ballabh’s lawyer told the SC that his client would stay away from Bihar during trial if he was grated bail but the SC rejected his lawyer’s plea and directed the the government to keep the accused in jail.
