Patna: Bihar government has decided to promote Anil Kumar Mahajan, an IAS of 1977 batch who was punished with compulsory retirement on October 15, 2007. He will get all inservice benefits including financial gains and promotion in the rank of chief secretary with retrospective effect, according to a communication published in state gazette on Monday.
Mahajan was retired in the rank of Special Secretary. A notification issued by General Administration department (GAD) says, Mahajan was suspended several times during his service. DOPT, Government of India, had opined “His conduct and behaviour clearly reflect loss of mental stability. He is unfit to be retained in the service. Punishment of compulsory retirement should be given to him.”
Following Government of India’s recommendation, Mahajan was punished with compulsory retirement. He later moved the High Court and Surpreme Court. The Apex court in civil appeal no 4944/2013 observed “The government did not constitute a medical board to find out whether the appellant(AK Mahajan) was insane.” His reinstatement was ordered. Later on, a contempt petition was filed in Supreme Court against Bihar Government. On April 18, 2016,the court found the issue a contempt of the court and asked the state to implement its earlier order. On July 4, the GAD issued a notification giving promotion and payment of all inservice benefits to Mahajan.
