Patna: The Supreme Court on  Tuesday refused to admit a petition seeking prosecution of Bihar CM  Nitish Kumar and  former spokesman of JD(U) Shivananad Tiwari  in Fodder Scam. The court dismissed the  petition observing it was aimed at publicity only. The petition was filed by Mithilesh Kumar Siingh, a resident of Buxar who had earlier moved a petition in Ranchi High Court too.

On December 22, 2012, Mithilesh Singh had filed a petition in the court of special CBI Judge, Ranchi, Sitaram Prasad seeking their prosecution alleging the two had benefitted from the scam and received money from the scam accused.
The court had dismissed his petition which was challenged in Randhi High Court where too it was rejected. The CBI told the trial court that the agency did not find any evidence against the two during investigation. Two former chief ministers Lalu Prasad and Jagannath Mishra were convicted by a CBI court in 2013 in the multi-crore Fodder scam.
