The quantum of punishment was announced in a jampacked court under tight security arrangement on Ara Civil Court premises. The five convicts sentenced to 7 years’ jails were Kishori Kumar Yadav, said to be an RJD leader of village Jamuaw, Vishnu Kumar alias Mithun of Bihia, Mumtaz Ansari alias Taaz of Sandaur, Binod Kumar Kesari alias Madayi Kesari of Ward No 2, and Sikandar Kumar, ward No 8, all under Bihia police station in Bhojpur district. The court sentenced them under section 147, 354B and section 3(i) (d), 3(s) of Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act,
The court also awarded two years imprisonment to 15 convicts including Ranjeet Kumar of ward No 6, Rajbali Kumar alias Badak of ward No 1, Satyanaryan Prasad of ward No 13, Lakhan Kumar of ward No 13, Rajesh Sharma alias Imarti of Jamuaw, Muni Sah of Jamuaw, Shubham Sharma of Dafali locality ward No 13, Amit Kumar Jaisawal alias Vikky of ward No 6, Sonu Kumar of Finagi, Vicky Singh alias Deepak Kumar Yadav of Saheb Tola, Suraj Kumar alias Pappu of Shubham Colony, all under Bihia police station, Rakesh Rai alias Piyush Rai of Damodarpur, Raja Sah of Damodarpur under Shahpur police station, and Babua Ji alias Gunga of Shivraj Ji Tola under Dhangai police station, and Vikas Rajak of ward No 6 under Bihia police station, under section 147 and under SC/ST (Prevention of Atrocities) Act.
Special Public Prosecutor Satyendra Kumar Singh said that the court had on November 28, 2018, convicted 20 persons for rioting, disrobing a woman and arson at Bihia in Bhojpur district on August 20, 2018, under section 147, 354B and section 3(i) (d), 3(s) of Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act and added that the court announced quantum of punishment on November 30, 2018.
Police had filed chargesheet against 22 named accused but one Pint Kumar is absconding and case of one named accused Gautam Kumar was sent to the Juvenile court for trial as he is minor.
The incident took place on August 20, 2018, and the statement of woman concerned was recorded on August 24, 2018, in the court while on September 5, 2018, police submitted the chargesheet against 22 persons. On September 13, 2018, the court took cognizance against 20 persons while on November 2, 2018, statements of accused were recorded in the court and on November 28, 2018, the court convicted all the 20 persons.
Three separate FIRs were lodged with the police under Bihia police station in connection with arson, murder of a youth Bimlesh Shah and stripping and parading of a woman naked. Anil Sah, deceased’s uncle, had lodged an FIR against some unidentified miscreants for killing of his nephew. Second FIR was lodged by the woman against 15 named and 100 unknown persons for thrashing, stripping, and parading her on roads while police had lodged a third FIR against seven named and 300 unnamed persons in connection with arson, rioting and rampage.
Police arrested 17 named accused in the FIR after going through video footage though one named accused Pappu Kumar is still absconding and police attached his properties on the order of the court. Four persons surrendered before the court. The arrested persons were paraded before the victim woman for identification. The woman is still living at a shelter home at Ara.
It may be mentioned here that body of Bimlesh Sah alias Chhotu Sah, son of Ganesh Sah of Damodar village under Shapur police station, was found on the railway tracks near the red light area known as dafali locality close to the Bihia railway station platform No 1 under Danapur rail division of the East Central Railway (ECR), Hajipur on August 20, 2018. He was to go to Patna to take admission to a Skill Development Centre but he reached the red light area known as Dafali locality under Bihia police station.
The people went on rampage after the body of Bimlesh Sah alias Chhotu Sah was found on the rail tracks and set ablaze at least half a dozen makeshift shops and other establishments in Bihia. The mob entered a house of woman who ran a theatre called ‘Halchal Gudia’, stripped her and paraded her naked on the road in full public view holding her responsible for the murder. The mob also clashed with police forcing them to open fire.
