Patna: Bihar Human Rights Commission (BHRC) on Thursday directed the state Home department to pay a compensation of Rs 50,000 within two months to a native of village Bhasar in Sitamarhi district Gadadhar Pathak for violation of his human rights by the investigatine retiredg officer (IO) of a November 2013 case B C Nayak. Nayak has since retired.
The BHRC has also directed the Home department/ SP, Sitamarhi, to inform it within two month about the disciplinary proceedings initiated against the retired IO.
Gadadhar Pathak, son of late Jageshwar Pathak, village Bhasar, under Sitamarhi Sadar police station, had complained to the commission regarding high-handedness of Investigating Officer(IO) of Sitamarhi Town police station case of November 5, 2013, lodged by him. The petitioner (71) alleged that he had complained against the IO to senior officers due to which he was annoyed and had warned to teach him a lesson.
SP, Sitamarhi, informed that chargesheet had been submitted on November 30, 2013, against the FIR accused in the case as per information given by IO B C Nayak. But, the petitioner contradicted it enclosing copy of the court order sheet indicating that chargesheet was not received in the court. SP, Sitamarhi, was directed to fix-up responsibility for deliberate withholding of chargesheet.
The SP’s report confirmed that chargesheet had not been received in the court, according to BHRC member Neelmani. Police Headquarters has sent a October 19, 2016, report from SP, Sitamarhi, indicating that duplicate charge-sheet with case diary was submitted before the court on September 23, 2016. SP, Sitamarhi has requested the state government for permission to initiate proceeding against the retired IO Nayak. The matter will be now heard on January 5, 2017.
