Patna HC directs Rohtas DM, CO, Bikramganj, to appear before it on Mar. 12, 2019

Sasaram : Patna High Court has asked District Magistrate (DM), Rohtas, and Circle Officer (CO), Bikramganj Circle, to appear before it personally with separate affidavit on March 12, 2019, in a case relating to delay in mutation.

Binit Kumar of village Dharupur under Bikramganj Circle in Rohtas district had applied for mutation of land on January 12, 2018, but it was not done within stipulated time. At this, Binit Kumar filed a writ petition in Patna High Court. The Court had ordered the government to file counter affidavit in the case within six weeks. A single bench of the court was informed on January 29, 2019, that the DM could not file counter affidavit as he was preoccupied with the matriculation examination.

Advocate Vishal Sourabh, Patna High Court, said that after hearing both the parties, the Court recently directed Rohtas DM and CO, Bikramganj, to appear before it personally with separate affidavit on March 12, 2019. He further said that as per the provision of Section 12, Bihar Mutation Act, mutation application should be disposed of within 33 days at any cost but the CO did not do it.
