Ara Court sentences 2 rape case accused to rigorous life imprisonment

Ara : Additional District and Sessions Judge, I, Ara,  R K Singh on August 10, 2019, sentenced to rigorous life imprisonment two persons : Manish Tiwari and Hare Ram Sah, owners of separate coaching institutes, of Lahari Tiwaridih village under Piro police station in Bhojpur district under section 376 IPC and POCSO Act for outraging modesty of a 12 year old girl. The court also slapped a fine of Rs 85,000 on each of them.

Special Pubic Prosecutor (PP)  Saroj Kumari said that Manish Tiwari and Hare Ram Sah used to enticed and take the 12 year old girl to secluded places on her way to school or when she went to play to secluded places and outraged her modesty frequently but she dared not complain to her parents. Meanwhile, she fell ill and her father took her to his in-laws’ place at Balia in Uttar Pradesh for treatment on July 10, 2016, where the doctor diagnosed that she was three months pregnant, Special PP Saroj Kumari said.  When the survivor was asked about it, she revealed that Manish Tiwari and Hare Ram Sah outraged her modesty frequently on her way to school or when she went to play, said the Special PP.

When the matter came to light, the father of the girl lodged a named FIR with Piro police station against Manish Tiwari and Hare Ram Sah charging them with raping his daughter  making her pregnant. After institution of FIR, police arrested both the named accused Manish Tiwari and Hare Ram Sahand sent them to jail. Police had also brought the girl over to Ara Sadar Hospital for medical examination and also produced her before an Ara Court to get her statement registered under Section 164 of CrPC.

After hearing both the parties, ADJ I, Ara,  R K Singh awarded rigorous life imprisonment to Manish Tiwari and Hare Ram Sah and also slapped a fine of Rs 85,000 on each of them.
