Ara: Chief Judicial Magistrate, Ara, B D Rai on Thursday ordered to lodge an FIR against  Station House Officer (SHO), Town police station, S K Sahi with the Town police station for not complying with the order of the court.

An advocate of  Ara Civil Court Satyabrat had filed a case in the court of the Chief Judicial Magistrate on November 3, 2010, against former Deputy Prime Minister Lal Krishna Adwani and CM Nitish Kumar for treason under section 124(K), conspiracy under section 120(B) and defamation under section 505 IPC. The lawyer said that both leaders at public meetings had said that criminals were ruling the roost and kidnapping industry was flourishing in Bihar and youths were given ‘kidnapping job’ during RJD regime and Nitish Kumar after becoming the Chief Minister had demolished the industry. The advocate sought information from the state Home department and range  DIG as to by which ordinance kidnapping industry was demolished. Both, however, said they had no information regarding this.

After hearing the petitioner, the CJM on February 9, 2015, had directed Town Police Station SHO to lodge a named FIR against  L K Adwani and  Nitish Kumar for spreading hatred in the society during assembly election meetings at Begusarai and Hajipur respectively on October 25, 2010.

But the SHO Town police station did not lodge an FIR and submitted a report in the court instead. At this the petitioner filed criminal revision 117/15 in the court of the District and  Sessions Judge and the court also retained the order and the SHO was asked to lodged an FIR on January 4, 2016, and a reminder was also sent to the PS on March 10, 2016. But, still the FIR was not lodged. The court sought an explanation from the SHO on April 18, 2016, and also sent a reminder on May 12, 2016, but the SHO failed to comply with the order. Then the petitioner filed a complaint  against the SHO and the Bhojpur SP was made a witness.
